Activity Waiver Release & Indemnity Agreement & Release of Liability Agreement For and in consideration of permitting (Participant(s) Name) ___________________________________________ to participate in The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC programs such as practices, games, camps, clinics, tryouts, trainings, and/or conditioning beginning on the today, the undersigned (Participant(s) and Parent(s)/Guardian(s) of Participant(s)) hereby voluntarily releases, discharges, waives, and relinquishes any and all actions or causes of action for personal injury, property damage or wrongful death occurring to him/herself/them arising as a result of engaging or receiving instructions in said activity or any activities incidental thereto wherever or however the same may occur and continue, and the undersigned does for him/herself, his/her heirs, executors, administrators and assigns hereby release, waive, discharge and relinquish any action or causes of action, aforesaid, which may hereafter arise for him/herself and for his/her estate, and agrees that under no circumstances will he/she/they or his/her/their heirs, executors, administrators and assigns prosecute, present any claim for person injury, property damage or wrongful death against The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC or any of its officers, agents, contractors or employees for any of said causes of action, whether the same shall arise by the negligence of any of said persons, or otherwise. It is the intention of (Participant(s) Name)___________________________________________________________ by this instrument, to exempt and relieve The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC from Liability for personal injury, property damage or wrongful death caused by negligence. The undersigned (Participant(s) and Parent(s)/Guardian(s) of Participant(s)), for him/herself/them, his/her/their heirs, executors, administrators or assigns, agrees that in the event any claim for personal injury, property damage or wrongful death shall not be prosecuted against The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC, he/she shall indemnify and save harmless the same The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC from any and all claims or causes of action by whomever or wherever made or presented for personal injuries, property damage or wrongful death. The undersigned (Participant(s) and Parent(s)/Guardian(s) of Participant(s)) acknowledges that he/she/they have read the forgoing Activity Waiver Release & Indemnity Agreement Notice and has been fully and completely advised of the potential dangers incidental to engaging in basketball/training physical activities and is fully aware of the legal consequences of signing the within statement. Basketball and training activities require some physical contact by the coach(es) for instruction, demonstration, and minimal anatomical adjustments. By signing below, I/We agree to this waiver release & indemnity agreement. I/We also acknowledge that I/We have received, read and understood the physical and mental expectations of The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC programs. Additionally, any Parent(s)/Guardian(s)/Person(s) who volunteers to assist in practice(s), games, camp(s), clinics, tryout(s), training(s), and/or conditioning is not associated with The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC; therefore, The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC is not liable and cannot be sued for any actions or causes of action for personal injury, negligence, property damage or wrongful death occurring to him/herself/them arising as a result of engaging or receiving instructions in said activity or any activities incidental thereto wherever or however the same may occur and continue, and the undersigned does for him/herself, his/her heirs, executors, administrators and assigns hereby release, waive, discharge and relinquish any action or causes of action, aforesaid, which may hereafter arise for him/herself and for his/her estate, and agrees that under no circumstances will he/she/they or his/her/their heirs, executors, administrators and assigns prosecute, present any claim for person injury, property damage or wrongful death against The Hoop & Ship Academy, Inc. or Hoop & Ship, LLC. Assumption of Risk: I, the Parent(s) and/or Guardian(s) of the Participant(s), willingly and freely assume all risks associated with myself, and my child's or children's participation in any Hoop & Ship Academy, Inc. or Hoop & Ship, LLC activities, including but not limited to, risk of injury, illness, and damage to my person or property. I understand the risks associated with myself, and my child or children participating in any Hoop & Ship Academy or Hoop & Ship, LLC activities. *

Emergency Medical Treatment: I, Parent(s) and/or Guardian(s) of the Participant(s), consent for myself and/or my child or children to receive medical treatment which may be deemed advisable in the event of an injury, accident, and/or illness during the activities. Media Release: I, Parent(s) and/or Guardian(s) of the Participant(s), grant Hoop & Ship Academy Inc. and Hoop & Ship, LLC the right to take photographs or video footage of me and my child or children during participation in any Hoop & Ship Academy Inc. or Hoop & Ship, LLC to use such media for any lawful purpose including but not limited to, publicity, illustration, advertising, web content, and social media platforms. Compliance with Policies: I, Parent(s) and/or Guardian(s) of the Participant(s), agree to comply with all rules, regulations, and safety procedures established by Hoop & Ship Academy Inc. and Hoop & Ship, LLC for the well-being of myself, and my child or children to minimize the risk of injury or contraction of diseases. Severability: If any clause or provision set forth in this wavier is determined to be illegal, invalid, or unenforceable under the present or future law, then it shall be severable without affecting the enforceability of all remaining clauses or provisions. Acknowledgement of Understanding: I, Parent(s) and/or Guardian(s) of the Participant(s), agree to comply with all rules, have read this waiver of liability, fully understand its terms, and understand that I am relinquishing substantial rights by signing it. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions, and provisions set forth. If the participant(s) is a minor, I, Parent(s) and/or Guardian(s) of the Participant(s), certify that I am the participant's parent or legal guardian and I make these representations and provide my agreement to this waiver and release on the participant's behalf. *
